I am living in Sydney and Tatsiana from Shire Migration kindly provided me with your contact details. She suggested that I reach out to you regarding my Student visa application. I received a Natural Justice Letter from the Department of Home Affairs on 16 June 2026.

The Department raised concerns about an IELTS Test Report Form that I provided in early June after they requested additional documents while reassessing my visa application.

By way of background, my Student visa application had been under review for almost two years before the ART set aside the Department’s decision and remitted the matter for reconsideration on 13 May 2026.

In response to the Natural Justice Letter, I prepared and submitted a detailed statement together with supporting documents explaining the circumstances surrounding the IELTS test and the steps I have taken since becoming aware of the Department’s concerns.

The Department acknowledged receipt of my submission and noted that I had contacted IELTS Australia and was still awaiting further information. They have since granted me an additional 28 days to provide them with IELTS Australia’s response.

I therefore have until 13 August 2026 to provide this information and, to date, I am still waiting to hear back from IELTS Australia.

In the meantime, I would like to prepare an addendum addressing any compelling or compassionate circumstances, together with any legal arguments that may support the exercise of the waiver provisions under PIC 4020(4), should PIC 4020 ultimately be found to apply.

I have completed most of the work on my case myself and am not looking for assistance with preparing the entire submission from scratch. Rather, I am seeking professional advice and assistance on whether there are legal arguments, policy considerations or relevant case law that may support my circumstances.

I would also like to mention that my circumstances do not involve family ties in Australia, such as a partner or dependent children. The arguments I am seeking to develop relate instead to my particular circumstances as an international student and and the particular circumstances that may be relevant should I be unable to complete my studies in Australia.

It is in this context that I am reaching out to you today.
