Request for Consultation – 407 Visa Sponsorship and Employment Agreement
Dear Wickham Lawyers,
I would like to arrange a consultation regarding a matter involving a Subclass 407 Training Visa, an employment agreement with an Australian employer, and potential sponsorship and contractual issues.
My wife was granted a Subclass 407 visa in February 2026. Prior to the visa grant, she received and accepted a formal Letter of Engagement from Affinity Education Group for a full-time Lead Educator position at Kids Academy Warnervale.
Since the visa was granted, we have been attempting to obtain confirmation regarding commencement and onboarding. However, despite repeated follow-ups through the employer and migration agent, we have not received a clear confirmation of the status of the placement.
We have incurred substantial costs in reliance on the arrangement, including visa-related expenses, health insurance, police clearances, passport renewals and associated migration costs.
We would like advice on:
The current legal position regarding the employment agreement and sponsorship arrangement.
Whether the employer has any continuing obligations under the agreement.
The implications for the 407 visa if the employer fails to proceed.
Whether a formal letter from a solicitor would be appropriate to obtain a definitive response from the employer.
We have available for review:
The signed Letter of Engagement.
Visa grant documentation.
Correspondence with the migration agent and employer.
Evidence of expenses incurred in reliance on the arrangement.
Could you please advise:
Whether this is a matter your firm can assist with.
The cost of an initial consultation.
The earliest available appointment.
Thank you for your time. I look forward to your response.
Kind regards,
Jayesh Bhatia
